Frequently Asked Questions About Trusts
- What makes the Pure Contract Trust better than a
Living Trust or some other kind of Trust?
- Does the Trust have to be declared to anyone?
- If the Trust is a juristic person, is it a US
person? If so, why is it not required to fulfill tax reporting and so forth?
If it is not a US person, what is it? What laws exempt trusts from such
requirements, and how solidly enforceable are they?
- How does a Trust avoid probate and inheritance
taxes?
- If all of my assets are in a Trust, do I need to
make a will?
- What happens to a Trust that I manage when I
die?
- Is the Pure Contract Trust good in other
countries?
- Can property in other countries be placed into a
Pure Contract Trust?
- The example "Trust Certificate" states
on the reverse side that on the death of the Certificate Holder, the certificate
becomes null and void. My understanding is that the Certificate Holder is the
benficiary of the Trust. Why then is the certificate not reassigned (presumably
by the Managing Director)?
- Can the Exchangor and the Managing Director be
the same person. That is, can I exchange something into a trust and then also
manage that Trust?
- Can I specify who the Ttrustees will be? (This
is a particularly important point since the contract is, in essence, giving
ownership of my property to the Trustees. Thus, as suggested by the entity
itself, this requires someone you "trust".)
- What is the relationship of the Trustees to the
assets of the Ttrust. Specifically, if the Trustees own the property, can they
exercise the rights of ownership? What prevents them from doing so?
- Do the Trustees know what's in the Trust? How
hard is it for them to find out? Who does know what's in it?
- What liabilities, if any, attach to the
Exchangor? To the Ttrustees? To the Managing Director(s)?
- Who should be the Managing Director of a Trust?
- Who should be the Trust Certificate Holder?
- What are good names for a Pure Trust?
- Can a Pure Contract Trust Organization Own
Shares?
